Top 10: Divorce online 

If you search for the subject of divorce on the internet, you will come across numerous offers from law firms that promise an "online divorce" quickly and easily at the click of a mouse.

This is certainly misleading some becouse a marriage cannot, of course, be ended with a simple click of the mouse. (1) Of course, there is nothing against finding and contacting a divorce lawyer over the internet.

 

Top 9: No liability for the cloakroom 

Even if a restaurateur with a sign excludes liability for the cloakroom, he is often liable anyway. Exception: if the guest leaves his cloakroom in a place that he himself can see, he is liable.

 

Top 8: Cancel table reservation

Anyone who reserves a table in a restaurant but then changes their minds and does not appear at the appropriate time without canceling can be offered to the cashier by the restaurant owner.

The latter may then demand appropriate compensation if, for example, he had called up additional staff for the evening.

 

Top 7: Drive barefoot

It is often said that one should not drive a car barefoot or with flip-flops. That is not right. If you are traveling by car for private reasons, it does not matter whether and with what kind of shoes you are traveling. Only those who drive professionally have to adhere to the employers'  liability insurance association regulations, which stipulate sturdy shoes.

 

Top 6: Gambling debts are debts of honor

Anyone who plays poker for money in private, for example, is not legally obliged actually to pay off their gambling debts with other players. No law obliges you actually to pay this "honorary debt." However, you will certainly not make yourself popular with your fellow players.

 

Top 5: Exchange goods

If you buy something in the store, you often assume that you can return it unopened and with a receipt within a certain period and get your money back. This is not true, however, because the following applies here: "Bought is bought". The goods can only be returned in any case if they are faulty. Everything else is pure goodwill from the seller. In the mail-order business, however, other provisions apply.

 

Top 4: Dog in the taxi 

If you are traveling with a dog, it will often be difficult to find a taxi to take you and your dog with you. From a legal point of view, however, taxi drivers are even obliged to take their four-legged friends with them, otherwise they face a fine. However, this does not apply if the dog is filthy or there is an obvious risk of damaging the vehicle.

 

Top 3: joyride by car 

Anyone who thinks they can drive their car anywhere and at any time is wrong. According to the law, driving for no reason unnecessarily pollutes the environment and traffic and is not allowed.

 

Top 2: Too little alcohol in the cocktail

Can you complain about a cocktail if it contains too little alcohol? Yes! According to the BGB, cocktails must be prepared properly. If the bartender saves too much on rum during happy hour, that's a legitimate point to let the cocktail go.

Even if a so-called "seminal space" has taken place, this does not release the man from his fatherly duties. This is shown by a ruling by the federal court of justice: A childless couple tried artificial insemination several times. After a few unsuccessful attempts, the man separated from his wife. However, she continued to the court's judgment; the man must now fully pay for the child despite the separation.
